Notable Results
In the case of Terrell Pankey and Smith County Stone, LLC v. Western Arkansas Rock, Inc., Attorneys Joshua Potter and Jacob Potter represented Western Arkansas Rock, Inc. in a lawsuit in federal court in the Western District of Arkansas. Western Arkansas Rock, Inc. owned a rock quarry and had been sued by a previous tenant for an alleged breach of a contract/mining lease the tenant had with WAR, Inc. Plaintiff’s sued WAR, Inc. for millions of dollars in lost royalties. Joshua L. Potter and Jacob S. Potter, on behalf of WAR, Inc., counter-sued for under-reporting of sales and royalties, deceit, and breach of contract under the terms of the mining lease between the parties.
After a four-day jury trial, the jury reached a verdict in favor of our client and WAR, Inc. was awarded damages in the amount of $460,231.04.
